Terms and conditions of use
The purpose of this document is to define the terms and conditions under which Gellé Frères France (GFF) makes available the site and the services available on the site to its users and, on the other hand, the way in which the user accesses the site and uses its services. Any connection to the site is subject to compliance with these conditions.
ARTICLE 1 – INTELLECTUAL PROPERTY
The general structure of www.gelle-freres.fr, as well as the text, graphics, images, sounds and videos which make it up, are the property of the publisher or its selected partners. Any representation and/or reproduction and/or partial or total use of the contents and services offered by the site www.gelle-freres.fr, by any process whatsoever, without the prior authorisation in writing of GFF and/or its partners is strictly prohibited and could constitute an infringement pursuant to articles L 335-2 and following of the French Intellectual Property Code.
The brands offered by GFF are trademarks which have been registered with the INPI. Any representation and/or reproduction and/or partial or total use of these brands, of whatever nature, is totally prohibited.

It’s possible to create a link to the cover page of this site without the express authorisation of the PUBLISHER. However, GFF reserves the right to demand the deletion of a link which it considers inconsistent with the purpose of the site www.gelle-freres.fr.

GFF reserves the right to correct them, as soon as it is made aware of these errors. ARTICLE 4 – ACCESS TO THE SITE
GFF shall endeavour to provide access to the site 24 hours a day, 7 days a week, except in the case of force majeure or an event beyond the control of GFF, and subject to any breakdowns and maintenance operations required for the proper functioning of the site and services. GFF therefore cannot guarantee the availability of the site and/or services, the reliability of transmissions and performance in terms of response time or quality. No technical assistance is provided to the user, whether by email or telephone. GFF shall not be liable if it is impossible to access this site and/or use the services.
In addition, GFF may interrupt access to the site or any part of the services at any time without notice, without the right to compensation. The user acknowledges and agrees that GFF shall not be liable for interruptions or for any consequences which may arise for the user or any third party.
ARTICLE 5 – CHANGES TO THE CONDITIONS OF USE
GFF reserves the right, at any time and without prior notice, to change the present conditions of use in order to adapt them to changes to the site and/or its use.
ARTICLE 6 – RULES FOR INTERNET USE
The user states that he/she accepts the characteristics and limitations of the internet and, in particular, acknowledges that:
* GFF assumes no liability for the services accessible via the internet and does not exercise any control whatsoever regarding the nature and characteristics of the data which may pass through its host server.
* The user acknowledges that the data circulating on the internet is not protected, particularly against possible misuse. The presence of the Gellé Frères brand establishes a mere presumption of authenticity. The communication of any information judged by the user to be of a sensitive or confidential nature is done at his/her own risk.
* The user acknowledges that the data circulating on the internet can be regulated in terms of use and can be of a proprietary nature.
* The user is solely responsible for the use of the data which he/she sees, queries and transfers on the internet.
* The user acknowledges that GFF has no means of controlling the content of services available on the internet.
ARTICLE 7 – APPLICABLE LAW
Both the present site and the terms and conditions of its use are governed by French law, regardless of the place of use. In case of any dispute and after the failure of any attempt to find an amicable solution, French courts will have sole jurisdiction to hear such a dispute.
ARTICLE 8 – CONFIDENTIALITY POLICY
GFF agrees to use Customers’ confidential information only in the context of the operation of its site and for commercial purposes. Gellé Frères France agrees to respect the confidentiality of personal data communicated by members on the website and to process data in compliance with the French Data Protection Law of January 6, 1978 relating to data processing, files and civil liberties. Gellé Frères France informs the member that this data will be used by its internal departments and/or those of its subsidiaries: to inform its customers of sales and upcoming events, by sending invitation emails, to process the member’s order – To reinforce and personalise communication by sending newsletters, special offers (including competitions, games, etc.)
For smooth order processing, collected personal data will be the subject of IT processing, which the Customer acknowledges. As such, the information concerning him/her can be communicated to the technical service providers of Gellé Frères France. Gellé Frères France will be able to use technical methods to obtain non-personal data about internet users and to improve the functionality of the site, for example by monitoring the number of visitors to certain pages.
Gellé Frères France will not be liable for any direct damage related to customers’ personal data. The data is stored in a secure server at GFF and with the “MailChimp” organisation. GFF shall not be liable for any use of the data collected by GFF which is used without GFF’s knowledge by a third party.
In addition, in accordance with the French Data Protection Act of 6 January 1978, a member may at any time exercise his/her right of access to the file, his/her right to object and his/her right to rectify or delete information concerning him/her by sending his/her request (stating his/her email address, surname, first name, postal address) by a letter weighing less than 20g, sent by standard post to: 19 av de l’Opéra-75001 Paris France.
This processing has been the subject of a declaration to the National Commission for Data Protection (CNIL).
